Terms of Service

1. Agreement to Terms

These Terms of Service (“Terms”) govern your access to and use of the Simple Momentum System website, indicators, expert advisors, Discord communities, and related services (collectively, the “Services”), operated by Simone A. Gooden-Guy (“we,” “us,” or “our”).

By accessing the Services at https://www.simplemomentumsystem.com, purchasing a subscription or product, joining our Discord server, or creating an account, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Services.

2. Eligibility

You must be at least 18 years old and legally able to enter into contracts to use the Services. By using the Services, you represent and warrant that you meet these requirements and that all information you provide is accurate and complete.

3. Products and Subscriptions

We offer digital trading tools, including but not limited to the SIMPLE MOMENTUM SYSTEM 4.2 indicator for MetaTrader 5 and TradingView, SMS Risk Manager 4.0, optional Discord access, and other solutions listed on our site.

  • Subscriptions. SMS 4.2 subscriptions renew automatically on a monthly or annual basis until cancelled. You are responsible for cancelling before the next billing date if you do not wish to renew.
  • One-time purchases. Products such as SMS Risk Manager 4.0 are sold as one-time licenses unless otherwise stated.
  • Limited availability. Access to SMS 4.2 + Discord is limited to 60 active members; SMS 4.2 Indicator Only is limited to 100 active members. Membership is offered on a first-come, first-served basis and may close without notice when capacity is reached.
  • Price changes. We may adjust pricing at any time. Changes apply to your next billing cycle after reasonable notice.

4. Payments and Billing

Payments are processed through Stripe. You agree to provide current, complete, and accurate billing information. All fees are payable in the currency displayed at checkout and are non-refundable except as expressly stated in our Refund Policy.

Charges for Simple Momentum System products and subscriptions will appear on your bank or card statement as VIJIO LLC.

Failed payments may result in suspension of access. If a payment fails, we may retry the payment method on file and may remove Discord roles or other member benefits after a reasonable grace period.

5. License and Intellectual Property

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the digital products you purchase for your personal or single-business trading use.

You may not copy, modify, reverse-engineer, decompile, distribute, resell, rent, lease, sublicense, share login credentials, or create derivative works from our products. All rights, title, and interest in the Services remain the exclusive property of Simone A. Gooden-Guy and Simple Momentum System.

6. Acceptable Use

You agree not to use the Services to:

  • Violate any applicable law or regulation;
  • Infringe the intellectual property or other rights of any person;
  • Share accounts, license keys, or Discord invite links publicly;
  • Harass, abuse, or disrupt other members or our staff;
  • Distribute malware, spam, or unauthorized promotional material;
  • Attempt to bypass access controls or security measures.

We reserve the right to suspend or terminate access for conduct that violates these rules or is otherwise harmful to the community or our business.

7. Discord Access

Discord access is a membership benefit tied to an active qualifying subscription. To receive and retain the paid-member role, you must link your Discord account through our authorized OAuth flow and maintain an active subscription in good standing.

If your subscription lapses, is cancelled, or a chargeback occurs, your Discord role may be removed and you may lose access to the server or restricted channels. We are not responsible for Discord platform outages, account restrictions, or changes to Discord’s terms that affect access.

8. Trading Risk Disclosure

Trading foreign exchange, futures, and other leveraged instruments carries a high level of risk and may not be suitable for all investors. Past performance is not indicative of future results. The Services are analytical tools only and do not constitute financial advice, investment recommendations, or guarantees of profit. You are solely responsible for your own trading decisions and risk management.

9. Refunds and Cancellations

All sales are final unless otherwise stated. Because our products are digital and delivered immediately, we generally do not offer refunds. You may cancel your subscription at any time through your billing portal or by contacting us at info@simplemomentumsystem.com. Cancellation stops future charges; it does not refund prior payments.

10. Disclaimer of Warranties

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS OR TRADING LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify and hold harmless Simone A. Gooden-Guy, Simple Momentum System, and their affiliates, officers, agents, and employees from any claims, liabilities, damages, losses, or expenses arising out of your use of the Services or violation of these Terms.

13. Termination

We may suspend or terminate your access to the Services at any time, with or without notice, for conduct that violates these Terms or for any other business reason. Upon termination, all licenses and membership benefits immediately cease.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New York, United States, without regard to conflict-of-law principles. Any dispute arising under these Terms shall be resolved in the state or federal courts located in New York County, New York.

15. Changes to These Terms

We may update these Terms from time to time. The updated version will be posted on this page with a revised effective date. Your continued use of the Services after changes are posted constitutes your acceptance of the revised Terms.
